Washington State: Paid Sick Leave Mandate for Rideshare Drivers

 

Effective January 1, 2023, Washington state will require rideshare companies such as Uber Technologies Inc. and Lift Inc. to provide paid sick leave for their drivers who are operating in Washington while rideshare drivers remain classified as independent contractors.

Eligible drivers in Washington will be able to accrue one hour of paid sick leave for every 40 hours spent driving passengers. Paid sick leave will become available to use after 90 hours of passenger platform time for the rideshare companies.

Paid sick leave can be used for specified reasons, including the drivers’ own condition or to care for their family member’s mental or physical illness, injury or health condition. Additionally, paid sick leave can be used for absences that qualify for leave under the Domestic Violence Leave Act.

Rideshare company employers who operate their service in Washington should be aware of the new changes and prepare to provide the required paid sick leave under the new law by January 1, 2023.
