On August 6, 2024, the Department of Commerce and Insurance issued Bulletin 24-02 to provide guidance regarding entities that meet the criteria for managed health insurance issuers (MHIIs) in Tennessee.
The bulletin clarifies that the definition of MHIIs is not limited to health maintenance organizations alone. Furthermore, many companies now offer plans in the state that provide health insurance coverage or benefits that fall within the scope of the state’s definition of MHIIs (generally, “an entity that offers a health plan that ‘restricts reimbursement for covered services to a defined network of providers’”). As such, these companies are subject to at least 12 sections of the state’s insurance code which are enumerated in the bulletin.
While this bulletin is directed at insurers, employers should be aware of its contents.
