Massachusetts Division of Insurance Reiterates Expectations Regarding Abortion Coverage

On June 24, 2024, the Massachusetts Division of Insurance issued Bulletin 2024-27 to identify the Division’s expectations regarding carrier coverage for abortion, abortion-related care, and medication abortion services. 

The bulletin essentially restates the Division’s expectations for these coverages as expressed in greater detail in Bulletin 2023-01, including a reminder that all insured health plans delivered, issued, or renewed in Massachusetts must cover all abortion and abortion-related care when provided to covered persons. It also reiterates the expectation that all insured health plans issued or renewed in the Commonwealth will continue to provide coverage for the prescribing, dispensing, and administration of mifepristone and misoprostol in Massachusetts without any cost-sharing except where allowed as described in Bulletin 2023-01. 

The bulletin follows the US Supreme Court’s decision that left in place FDA rules that expanded access to mifepristone but also left the door open to future challenges to those rules. The recent release of the bulletin signals the Division’s strong interest in maintaining carrier coverage for abortion-related care and services. Employers with insured health plans delivered, issued, or renewed in Massachusetts should take note of the Division’s reinforcement of these coverage requirements.
