Effective for plan years on or after January 1, 2026, group health insurance, HMOs, Medicaid, and individual policies in Delaware must cover abortion-related services without referral, prior authorization, or cost-sharing up to $750 per year per enrollee. Further, coverage provided under this provision may not be subject to any deductible, coinsurance, copayment, or any other cost-sharing requirement up to the $750 maximum.
Certain religious employers may request to exclude the abortion-related service coverage if the coverage requirement conflicts with the religious organization’s bona fide religious beliefs and practices. However, religious employers must still cover termination of pregnancy that is necessary to preserve the life or health of a covered individual.
Employers who sponsor fully insured plans should review this update and consult with their medical carrier regarding whether the requirement would apply to their plans in 2026.
